Actually, no. SCO had acquired the rights to sell licenses for UNIX and UnixWare so Sun still has a legal license.
Novell, on the other hand, hasn't received its cut of the deal from SCO.

Yes, but likely Sun will negotiate a contract with Novell and sue SCO for
misrepresentation of title and breach of contract. When SCO files bankruptcy,
