What effect do you think the ever-present specter of jail time for
"attempted copyright infringement" looming over our heads would have on
innovation in software development? Any time you write code, you run
the risk of prosecution under the terms of legislation like this.

Yes, it's arbitrary, overly broad, and draconian -- and for those
reasons, it's becoming increasingly dangerous to try to innovate in the
software industry.
